Sexual Misconduct Reporting Mechanism – Welfare Academy

Purpose

The Sexual Misconduct Reporting Mechanism establishes a clear, safe, trauma-informed, and legally compliant framework for the reporting, management, investigation, support, and resolution of sexual misconduct concerns involving students, staff, contractors, visitors, or associated individuals connected with Welfare Academy.

  1. Scope

This mechanism applies to students, staff members, tutors, assessors, contractors, placement providers, visitors, and third parties interacting with Welfare Academy. It applies to incidents occurring on institutional premises, during online learning, placements, institutional events, or through digital communication.

  1. Institutional Commitment

Welfare Academy adopts a zero-tolerance approach toward sexual misconduct. The institution shall respond in a trauma-informed and non-judgemental manner, protect reporting individuals from victimisation, maintain confidentiality where reasonably possible, and provide welfare and safeguarding support.

  1. Definition of Sexual Misconduct

Sexual misconduct includes, but is not limited to:

β€’ Unwanted sexual touching
β€’ Sexual violence
β€’ Online sexual harassment
β€’ Sexual exploitation
β€’ Grooming
β€’ Abuse of power for sexual purposes

Students may also be referred to NHS Sexual Assault Referral Centres (SARCs) for medical and emotional support.

Staff must:

  1. Confidentiality and Information Sharing

Reports shall be managed confidentially in accordance with:

Confidentiality may be overridden where there is immediate risk to life or safeguarding concerns.

  1. Criminal Conduct

Sexual misconduct may constitute criminal behaviour. Welfare Academy shall not prevent individuals from reporting concerns to police and may cooperate fully with police or safeguarding investigations.

β€’ External advocacy services

  1. False or Malicious Allegations

The institution recognises that intentionally false or malicious allegations may constitute misconduct; however, inability to substantiate a concern shall not automatically imply bad faith.

Retaliation against individuals who disclose or participate in investigations is prohibited, including:

Tutors and Assessors must:

β€’ Student safeguarding support

  1. Staff Training

Relevant staff shall receive training in:

  1. Documentation and Record Keeping

All reports, investigations, safeguarding actions, referrals, and outcomes shall be securely documented and retained in accordance with institutional retention policies and UK data protection legislation.

  1. Equality and Non-Discrimination

This mechanism operates in accordance with the Equality Act 2010. Support shall be inclusive and accessible to all individuals regardless of disability, gender identity, sexual orientation, ethnicity, cultural background, or immigration status.
